1.1 Acceptance of Terms
By accessing or using VBot, provided by Robo The Virtual Bot Inc, you agree to be bound by these Terms of Use ("Agreement").
This Agreement governs your access to and use of VBot. If you are entering into this Agreement on behalf of a company or other legal entity,
you represent that you have the authority to bind such entity to these terms, in which case the terms "you" or "your" shall refer to such entity.
If you do not have such authority, or if you do not agree with these terms,
you must not accept this Agreement and may not use the services.
2.1 Services Provided
VBot is a cloud-based artificial intelligence service that provides interactive and automated conversational capabilities suitable for a variety of applications such as customer support and business process automation.
With VBot, you can configure, customize, and manage your interactions to suit your specific requirements. Additionally, VBot supports embedding, phone number integration, and SMS capabilities to enhance your communication needs.
2.2 Use of the Service
You are granted a non-exclusive, non-transferable, revocable license to access and use VBot strictly in accordance with this Agreement.
VBot is available 24/7, subject to periodic maintenance and updates.
You may personalize VBot and are responsible for your interactions with the service.
3.1 User Responsibilities
You must ensure that all activity under your account complies with the provisions of this Agreement.
You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer,
and you agree to accept responsibility for all activities that occur under your account or password.
4.1 Intellectual Property Rights
Robo The Virtual Bot Inc owner of Vbot retains all rights, title, and interest in and to VBot and all related software and technology.
No rights are granted to you other than as expressly set forth in this Agreement.
4.2 Company-Provided Phone
Any phone numbers provided by us for use with VBot are owned by us.
You are granted a temporary, revocable right to use these numbers in connection with your VBot service.
5.1 Prohibited Uses
You may not:
- Modify, disrupt, or interfere with VBot or its associated software.
- Reverse engineer, decompile, or disassemble VBot.
- Use VBot in any manner that could damage, disable, overburden, or impair the service.
- Attempt to decipher the source code or fundamental components of the Service.
5.2 Use of Phone Numbers
You agree not to use the phone numbers provided for any unlawful or prohibited activities.
Upon termination of your VBot service, your right to use these phone numbers will immediately cease.
6.1 Subscription and Billing
VBot subscriptions are available on a month-to-month basis and are facilitated through a third-party provider.
You may subscribe either via our website or through an authorized distributor.
All subscriptions automatically renew each month unless cancelled.
6.2 Trial Periods
We may offer a trial period during which you can try VBot for free. Details of the trial terms will be provided at the start of the trial.
Unless you cancel before the end of the trial period, your subscription will automatically continue into a paid monthly subscription.
6.3 Fees and Payment
Subscription fees are billed monthly and are non-refundable, except as required by law.
You agree to provide current, complete, and accurate purchase and account information for all purchases made at our website.
6.4 Changes in Fees
We reserve the right to adjust pricing for our service or any components thereof in any manner and at any time as we may determine in our sole and absolute discretion.
Any price changes to your service will take effect following email notice to you.
7.1 Data Use
Your use of VBot is subject to Robo The Virtual Bot's Privacy Policy,
which governs our collection, use, and disclosure of your personal
information and is incorporated into this Agreement by reference.
8.1 Restriction
Robo The Virtual Bot Inc reserves the right to terminate your access to VBot if you violate the terms of this Agreement.
8.2 By You
You may terminate your subscription to VBot at any time via your account management page or by contacting customer service.
Termination will take effect at the end of the current billing cycle, and you will have access to the service until then.
8.3 By Us
We reserve the right to terminate or suspend your account and access to the services if you fail to comply with these terms,
if we suspect fraudulent, abusive or illegal activity, or if we otherwise terminate the VBot service in its entirety.
8.4 Effect of Termination
Upon termination, all rights granted to you in these terms will immediately cease.
Any data or content stored in your account will be lost unless it is specifically stated that we will maintain it for a limited period.
8.5 Survival
Sections regarding intellectual property rights, indemnification, limitations of liability,
and terms that by their nature should survive termination will remain in effect after the termination of this Agreement.
9.1 Modifications to Terms
Robo The Virtual Bot reserves the right to modify these terms at any time.
Your continued use of VBot after any such changes shall constitute your consent to such changes.
9.2 Governing Law
This Agreement is governed by the laws of the jurisdiction in which Robo The Virtual Bot Inc is located,
without regard to its conflict of law provisions.
9.3 General Provisions
This Agreement constitutes the entire agreement between you and Robo The Virtual Bot regarding your use of VBot.
Our failure to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision.
9.4 Limitation of Liability
In no event will Robo The Virtual Bot, its directors, employees,
or agents be liable for any special, indirect, incidental, or consequential damages, or damages for lost profits,
loss of revenue, loss of use, system failures, software errors, or any other technical malfunctions arising out of
or related to the VBot platform or the information contained in it, whether such damages arise in contract, negligence,
tort, under statute, in equity, at law, or otherwise,
even if Robo The Virtual Bot has been advised of the possibility of such damages.
9.5 Confidential Information
During the use of VBot, you may receive information relating to us or to VBot that is not known to the general public
("Confidential Information"). You agree that: (a) all Confidential Information will remain Robo The Virtual Bot's exclusive property;
(b) you will use Confidential Information only as is reasonably necessary for your participation in VBot;
(c) you will not otherwise disclose Confidential Information to any other party without our prior written consent.
9.6 Information Protection
You must protect the confidentiality of any such Confidential Information in the same
manner you protect the confidentiality of your own proprietary and confidential information,
but in no case shall you exercise less than reasonable care in protecting such Confidential Information.
9.7 Email Communication
By creating an account with VBot, you agree that Robo The Virtual Bot Inc may send you communications via email regarding your account,
our services, customer support issues, and promotions that may be of interest to you.
You may opt out of receiving promotional emails by following the unsubscribe instructions provided in the email.
9.8 Advertisements
VBot may display advertisements and promotions from third parties on or through the service.
Your business dealings or correspondence with, or participation in promotions of, advertisers other than Robo The Virtual Bot Inc, and any terms,
conditions, warranties, or representations associated with such dealings, are solely between you and such third party.
Robo The Virtual Bot Inc is not responsible or liable for any loss or damage of any sort incurred as the result
of any such dealings or as the result of the presence of third-party advertisers on the VBot service.
